Terms of Service

By opening an account or using any service offered by ABS Group Holdings ("ABS Group," "we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. Please read them carefully before using our services.

Account Agreement

When you open an account with ABS Group, you enter into a binding account agreement that governs the terms under which your account is maintained. This agreement includes, but is not limited to, your rights and obligations as an account holder, fee schedules, transaction limits, and dispute resolution procedures. A complete copy of the account agreement is provided at account opening and is available upon request at any branch or through online banking.

ABS Group reserves the right to modify these terms at any time. Material changes will be communicated to you at least 30 days in advance via your registered email address or through a notice in your online banking portal. Continued use of our services following such notification constitutes your acceptance of the updated terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States and applicable state law, without regard to conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of federal and state courts located in the United States, except where arbitration is required pursuant to our Arbitration Agreement, which is incorporated by reference into these Terms of Service.

Important: Disputes involving amounts of $10,000 or less may be brought in small claims court at your election. For amounts above this threshold, binding arbitration applies unless you opt out within 30 days of account opening. Please refer to the full account agreement for complete arbitration terms.

Privacy Policy Summary

What We Collect

We collect information you provide directly (name, address, date of birth, Social Security number, government ID, financial information), information generated through your use of our services (transaction history, account balances, login activity, device and browser information), and information from third parties (credit bureaus, identity verification services, and fraud prevention agencies).

How We Use It

Your information is used to open and manage your accounts, process transactions, comply with legal and regulatory obligations (including Bank Secrecy Act and anti-money laundering requirements), detect and prevent fraud, improve our products and services, and communicate with you about your account and our offerings.

We do not sell your personal information to third parties. We may share information with service providers who assist us in delivering our services, always under strict data protection agreements, and with regulatory and law enforcement agencies as required by applicable law.

Your Rights

Depending on your state of residence, you may have rights to access, correct, delete, or restrict processing of your personal data. Our full Privacy Notice, as required under the Gramm-Leach-Bliley Act, is mailed annually to all account holders and is available at any branch or through online banking.

FDIC Insurance Notice

ABS Group Holdings is a Member FDIC. Deposits are insured by the Federal Deposit Insurance Corporation (FDIC) up to $250,000 per depositor, per insured bank, for each account ownership category.

The standard FDIC insurance amount is $250,000 per depositor, per FDIC-insured bank, per ownership category. This means that a single depositor with accounts in multiple ownership categories (such as individual, joint, retirement, and trust accounts) may be insured for more than $250,000 in aggregate across those categories.

FDIC insurance covers deposit accounts including checking accounts, savings accounts, money market deposit accounts (MMDAs), and certificates of deposit (CDs). It does not cover investment products such as stocks, bonds, mutual funds, life insurance policies, annuities, or securities — even if they are purchased through or held at an FDIC-insured bank.

Regulatory Disclosures

ABS Group Holdings is a federally chartered bank regulated by the Office of the Comptroller of the Currency (OCC), the Federal Reserve System, and the Consumer Financial Protection Bureau (CFPB). State Licenses

ABS Group Holdings holds state banking licenses and/or money transmission licenses in all states where it conducts business. Anti-Money Laundering

In accordance with the Bank Secrecy Act (BSA) and USA PATRIOT Act, ABS Group maintains a robust Anti-Money Laundering (AML) compliance program. We are required to verify the identity of all customers at account opening, monitor transactions for suspicious activity, and file Currency Transaction Reports (CTRs) for cash transactions exceeding $10,000. Suspicious activity is reported to the Financial Crimes Enforcement Network (FinCEN) as required by law.

CRA Public File

In compliance with the Community Reinvestment Act, ABS Group's CRA Public File is available for inspection at our main office during normal business hours, and portions are available on our website. The CRA Public File includes our most recent CRA performance evaluation and information about our community development activities.
